Ziyaratislam - Terms & Conditions

As a user of the Ziyaratislam website, you must understand and agree to the terms and conditions outlined in this User Agreement. By accessing and using the website and making any bookings, you indicate your acceptance of these terms and conditions without qualification.

If at any point you disagree with any part of this User Agreement, you mustn't use the website in any way and refrain from making any bookings. You must take the time to carefully read and understand these terms and conditions before proceeding to use the website and make any bookings.

1. Your Contract

Bookings are orders you place for goods or services through our website. Once we have received complete payment from you and sent a confirmation email, which may come from either Ziyaratislam or the pertinent Travel Supplier, this booking will be regarded as approved by Ziyaratislam, and a contract will be established.

Please note that the availability of all travel-related goods and services mentioned on our website is subject to change. Depending on the type of product you have selected to book, the particular terms and conditions of your reservation will vary.

The terms and conditions that apply specifically to flight + hotel packages can be found in Section 4 of this document if you have chosen to book a flight + hotel package. Your contract will be with Ziyaratislam.

On the other hand, a DIY Package is when you decide to combine two or more different types of products from our websites, such as transportation, lodging, or other tourist services, which make up a significant portion of your booking, and you book these products at the same time for one overall price. In this situation, I'timaar will serve as an agent for outside vendors like airlines, hotels, insurance providers, automobile rental agencies, and others (Travel Supplier).

A. Travel Suppliers

It's crucial to understand that while making a reservation through Ziyaratislam, the company works as a third-party agency for numerous suppliers for all items other than flight + hotel package holidays. These are referred to as "Travel Suppliers'' and include tour operators, hotels, insurance firms, vehicle rental agencies, and airlines.

It is significant to remember that the specific Travel Supplier is the party with whom you have a contract for these products. You should contact them directly with any queries or issues with the product. The "further info" portion of the product listing and the confirmation email received by the supplier or Ziyaratislam contain the supplier's name and contact information.

B. Flights

When making a flight reservation, be aware that your fare may include additional conditions, such as non-changeable and non-refundable policies for "economy-restricted" tickets. Select the "View Fare Rules" option during the booking procedure to view these regulations. Flights must be used in the sequence specified on your itinerary; otherwise, the remainder of your ticket may be deemed invalid.

It is advised to check in 90 minutes before departure for domestic flights and 120 minutes before departure for international flights. Additionally, you should verify your return flight reservation with your airline at least 72 hours before departure. Failure to do so can result in cancellation. Airlines reserve the right to make schedule changes and cancel confirmed bookings. While Ziyaratislam, as an agent, is not responsible for such changes, they will assist with customer service.

C. Hotels and other Accommodation

Hotel and accommodation star ratings provided on our website are intended as a general guide and may not reflect official local ratings. Standards can vary between hotels and accommodations of the same class in different countries and even within the same country. It's important to remember that a 3-star hotel in one country may not be equivalent to a 3-star hotel in another.

Many hotels and accommodations, especially in popular tourist destinations, host conventions and conferences and may have an influx of groups such as students, associations, or clubs at certain times of the year. It's also worth noting that the properties featured on our website are not exclusively used by our guests and may be shared with travelers from diverse backgrounds and cultures.

D. General

You can add your frequent flyer or hotel loyalty program details while booking a flight or a hotel. Keep in mind that these programs are subject to the specific airline or hotel's restrictions and limitations. These phrases may not apply to all fare classes or services. If you have any questions about these rules, please contact the airline or hotel running the program.

Also, keep in mind that our travel providers have loyalty card policies. Please contact them directly if you have any questions. Furthermore, please be informed that special requests such as meals, disability accommodations, or child seats are not guaranteed by Ziyaratislam but will be forwarded to the travel provider or hotel. You are responsible for confirming with them if these requests can be fulfilled.

2. Delivery of Your Booking

Security: Our website takes necessary measures to protect your information from loss, misuse and alteration. We use SSL technology to keep your information private during flight bookings and order forms. We also have a firewall to prevent unauthorized access to our systems.

E-tickets: During the booking process, you can choose between an e-ticket or a paper ticket. However, please note that airlines have their own rules and regulations regarding e-ticketing. We recommend checking these details with the airline before travel. We are not responsible for non-compliance with these rules.

3. Cancellations or Modifications by you to your Booking

The terms and conditions for canceling or modifying a booked product or service will vary depending on the travel supplier or hotel. It may not be possible to cancel or modify some products or services, and there may be specific requirements that need to be met. For flight bookings, car rentals, and insurance, you can contact our call center or email us to cancel or modify your booking. For car rentals, a fee of £15 will be imposed for reservations canceled or amended within seven days of the booking date. A fee of £40 will be imposed for reservations canceled or amended more than seven days after the booking date.

4. Terms and Conditions relating exclusively to Flight+Hotel Packages

Ziyaratislam provides ATOL-protected Flight + Hotel Packages for your peace of mind. All Flight + Hotel Packages are subject to the relevant terms and conditions, which must be accepted before booking. Although we will try to provide the services included in your Flight + Hotel Package, we may need to change or cancel the package due to certain events outside our control. In such circumstances, we will let you know as soon as possible and offer suitable alternatives if they are available.

If it is impossible to provide an acceptable alternative, you will receive a full refund from Ziyaratislam. For children invoiced at reduced rates, compensation will be awarded on a pro-rata basis of the adult rate. Please note that no compensation is payable for any cancellations or alterations resulting from events that our Travel Suppliers or we could not have foreseen.

5. Payment

Payment for all Flight + Hotel packages, air transportation services, insurance products, and car rentals (except for pay-on-arrival car rentals) must be made at the time of booking. Please note that additional charges may apply to a car rental reservation (e.g., optional insurance, additional drivers, mileage). Payment requirements vary per hotel: full payment at the time of booking, a deposit at the moment of reserving with the remaining balance due at checkout, or full payment on check-out.

Refer to the 'Payment Summary' when booking or consult your confirmation email to determine how payment applies in any hotel. Payment will be accepted from Ziyaratislam, the Travel Supplier, the hotel, or its representative directly. Certain local taxes may apply and be collected by certain hotels additionally. Ziyaratislam might need to transfer your credit card details to the relevant Travel Supplier to complete your reservation.

Other payment methods than those mentioned on our website are not allowed, and we do not accept responsibility for any cash or cheques sent through postal mail. No tickets can be issued before full payment is received, but you remain liable and subject to a payment agreement for travel services purchased through us.

Other Generally Applicable Terms

When traveling within or outside of the EU or with an EU carrier, you may have certain rights that you can assert against the airline in case of canceled, delayed, or denied boarding.

A. Liability of Itimaar

Suppose you have purchased a Flight + Hotel Package from Ziyaratislam. In that case, the company is responsible for ensuring that the package is provided as described on the website and for any issues that arise directly from their negligence or breach of contract. Additionally, Ziyaratislam takes responsibility for any negligent actions or omissions of their travel suppliers while providing services or arrangements as part of the package. However, if you have purchased a DIY Package or any other product, your contract is with the travel supplier, and Ziyaratislam only acts as an agent. In this case, while they cannot compensate you, they will try to contact the travel supplier on your behalf. Ziyaratislam does not accept liability for any issues that are not caused by their fault, their agents, or travel suppliers.

B. Queries and Complaints relating to your Booking

Please contact our customer service team if you have any questions or complaints regarding your booking before departure. If you complain about a travel supplier or hotel during your stay, officially log it with the relevant party before leaving. If you have any other concerns or complaints about your booking while on your trip, please contact our customer service team within 30 days of returning and provide your booking reference and all relevant information.

If we or any of our travel suppliers require additional information, it must be provided promptly in writing. This process is important as it allows us and our travel suppliers to investigate and resolve any issues properly. Failure to follow this procedure may prevent us from accepting responsibility for complaints related to Flight + Hotel Packages.

C. APIS

Airlines must collect Advance Passenger Information from passengers before departure when traveling to certain countries, including the USA. Ziyaratislam facilitates this process and will ask you to provide necessary information such as your passport details, city and country of residence, and destination address for those traveling to the USA. It is important that this information is accurate so there are no delays when passing through Immigration upon arrival. Ziyaratislam may pass this information on to the respective airline, which may, in turn, pass it on to foreign authorities. Failure to provide valid and complete Advance Passenger Information at the time of reservation may result in being refused entry into these countries.

D. Customer Behaviour

You must conduct yourself in a manner that is not inappropriate, offensive, or dangerous to others while on your trip or using a service/product. If we deem your behavior as such, we and/or our travel suppliers may cancel your booking right away, making you ineligible for any refunds or compensation. You must also reimburse us for any expenses incurred due to the cancellation.
